Can anyone conduct a MA home inspection?

Massachusetts regulates home inspectors as of 2001. Massachusetts General Laws (MGL) and Codes of Massachusetts Regulations (CMR) include definitions for Home Inspection, Home Inspectors and the conditions when the terms apply.

Can anyone conduct a home inspection in MA?

Yes.  As long as no compensation is paid to the person performing the inspection.

No.  A person performing a home inspection in MA for compensation is required to be licensed by the Board of Registration of Home Inspectors.

MGL Chapter 112 Section 222 – No person shall conduct a home inspection for compensation unless licensed by the board in accordance with this section and said sections 223 to 226, inclusive, and unless he provides a written report of the home inspection.

Comments

The term home inspection was widely used prior to the Massachusetts General Laws requiring a license for a person performing a home inspection for compensation. The term home inspection can still be used by non-licensed MA home inspectors as long as there is no compensation being paid to the person performing the home inspection.

Remember Massachusetts General Laws are not intended to unlawfully restrict a person’s opinion or right to free speech. It is OK to have a spouse, relative, friend of the family or other trusted adviser inspect your home as long as there is no compensation paid to the person performing the inspection.

Can anyone work as a home inspector in MA?

NO.  A person working (receiving compensation) as a home inspector in Massachusetts is required to be licensed in accordance with Massachusetts General Laws sections 223 to 226 inclusive.

YES.  The requirements contained in MGL chapter 112 section 222 shall not be construed to prevent any of the following persons from acting within the scope of their profession: (12) a person making a home inspection in the presence of a licensed home inspector for the purpose of meeting the requirements of section 223 to qualify for licensure as an associate home inspector.

Attend a Board approved 75 hour training program.

Are you interested in working as a home inspector in Massachusetts?

Massachusetts requires a person to complete a Board approved 75 hour training program as one of the requirements to apply for an Associate Home Inspector license. Enroll in a Board approved 75 hour training program by a Board approved Provider in Framingham MA or Marlborough MA.

The Fall 2016 classes begin on September 12, 2016 in Framingham MA.

  • Dates: September 20, 2016 to December 21, 2016.
  • Times: Monday and Wednesday evenings from 6:30pm to 9:30pm

The Fall 2016 classes begin on September 20, 2016 in Marlborough MA.

Do Massachusetts closing attorneys do enough?

Anyone who has purchased a home in Massachusetts knows about the burden of extensive paperwork and document signing when it comes time for the closing.   Some have said that you have to bring two pens since there isn’t enough ink in one pen.

The Commonwealth of Massachusetts does not prohibit a Real Estate Attorney from holding other licenses such as a Real Estate Broker or Salesperson.  So how is the Massachusetts home buyer protected from a conflict of interest?

Do Massachusetts closing attorneys check for compliance with Massachusetts General Law Chapter 112 section 87yy1/2 ?

In 2001, The Commonwealth of Massachusetts requires licensing of Home Inspectors to protect the home buyer from collusion between Real Estate Brokers & Salesperson and the Home Inspector.   Specifically, Massachusetts General Law Chapter 112: Registration of certain professions and occupations, Section 87YY1/2: First signing of purchase agreement, distribution of home inspection brochure, prohibition of specific recommendations, exception

In short, the seller or seller’s representative must provide the buyer with the Home Inspectors Facts For Consumers Sheet at the time of the signing of the first written contract to purchase.
